General Terms & Conditions

Application: Interested investor shall submit application in prescribed form duly signed by him/ her along with earnest money. EFL reserves the right to accept or reject any application without assigning any reason. Investors willing to make a one time payment will be given preference.

Allotment: will be made on a first-come-first- served basis. On acceptance of application, and receipt of the earnest money and down payment, EFL will issue an allotment letter to the investor on receipt of which he/she shall start making payments as per schedule of payments mentioned in the brochure. Investor willing to make one time payment will be rewarded with substantial rebate. Until the full payment of installments, the investor shall have no right to transfer the allotment to a third party.

Payments: All payments should be made by A/C payee cheque or bank draft or pay-order or cash, in favor of "Emerald Foundation Ltd." Bangladeshis residing abroad may remit payments by TT or DD.

Schedule Of Payment: The investor must strictly follow the payment schedule. EFL may issue reminders to the investor for delay in payment beyond due date. The investor is liable to pay a delay charge @ 5% per month on defaulted payment. If the payment is delayed beyond 2 months EFL shall have the right to cancel the allotment. In the event of cancellation of allotment or surrender of allotted apartment, due refund will be made only after deducting the earnest money and realizing the required amount for refund from the new investor.

Company's Right: The company may make minor changes in the design both Architectural & Structural of the project, should these become necessary Limited changes in the specification and facilities may be made by EFL for overall interest of the projects.

Handover: The possession of each apartment and parking space shall be handed over to the allottee on full payment of installments and other charges, dues etc. Handover may be delayed for reasons beyond control of EFL such as force majeure, natural calamities, political disturbances, strikes, Acts of God or economic conditions, etc. Prior to this, Possession will only be handed over after the full payment of installments.

Utility Connection: Connection fee, security deposit for water. Gas & Electricity and incidental costs relating to these are not included in the apartment price installments for the EFL apartment. EFL will make these payments directly to the authorities concerned and the investors shall reimburse the same to EFL.

Transfer of Ownership: Proportionate share of indivisible land as well as apartment will be registered in favor of each investor as per the current rules & regulations of RAJUK. If the ownership required to be registered other then the name of investor. A service charge will be imposed as determined by EFL.

Design Change: After taking over Apartment or the project, the allottee(s) must consult Emerald foundation Ltd prior to undertaking any structural or layout changes within the building complex. Failure to do so will be at the sole risk of the allot tee(s).

Management:
* The allottee(s) can not do any construction work (e.g. change of internal layout plan) within the apartment unit allotted to him or any other areas of apartment compound without the permission of the company.

* The investor must undertake to become a member of the Owners' Association which will be formed by the owners of the apartments for management of the general affairs of the complex for common interest. Each apartment owner (for each allotment of apartment) must initially deposit Tk. 25,000/-in the reserve fund of the association for maintaining management expenses of the complex.
